The Massage Membership Agreement entitles the member to 1 massage each month for a minimum of 3 full months. Following the initial 3 month term the membership will automatically continue on a month-to-month basis until cancelled, terminated or placed on hold. This membership entitles you to 10% off any additional regularly priced massage services, not to be combined with other discounts. Sessions do not "roll over" month to month, and must be scheduled, but not necessarily redeemed by the 20th each month.
This Massage Membership Agreement is entered into as of the date signed above, between Massage Associates LLC and the new Member signing the contract, for the purpose of the Member to purchase an automatically renewable month-to-month Massage Membership for a specified dollar amount each month for a minimum of three full months. Following the initial three-month term, the Membership will automatically continue on a month-to-month basis at the predetermined rate until the Membership is cancelled, terminated or placed on hold. This Membership entitles the Member to receive their specified massage service once per month as well as other Membership benefits. The Membership status must be active (not on hold) in order to redeem Membership services and benefits. This Membership entitles the Member to one of the specified sessions per month as well as 10% off any additional regularly priced massage services. Membership discounts cannot be combined and may not be used with any other offer. The Membership monthly fee is specified on the application above. As long as the Membership monthly payment is made the Member will be considered an active Member in good standing. The first monthly fee will be charged at the time of the new Member’s first Membership service, with subsequent automatic billings being on the 1st of each month and no later than the 10th. Payment for any additional benefits or upgrades used will be collected on the day of service. Unused, prepaid services do not accrue from month to month and the Member’s monthly appointment must be scheduled (but not necessarily received) by the 20th of the month to guarantee massage openings are available. Memberships and services purchased under this Membership agreement are non-transferable to any other person or entity and are not exclusively provided by any particular therapist. Upgrade’s may be offered, and applicable fees will be calculated according to the difference in price of the current Membership and the upgraded service Membership price as listed on this agreement. Services may not be split into multiple visits.
We will use our best efforts to process all payments properly. However, we shall incur no liability if we are unable to completely process any payments because of the existence of any of the following circumstances: 1. If through no fault of ours, the payment account does not contain sufficient funds to complete the transaction or the transaction would exceed the credit limit of the credit card, or the payment account or credit card does not otherwise permit the transaction to be executed; or 2. The Member has not provided us with the correct account information to process the payment accurately; or 3. Circumstances beyond our control, such as but not limited to fire, flood, acts of war, terrorism, pandemics or other interference from an outside force, prevent the proper execution of the transaction and we have taken reasonable precautions to avoid those circumstances. For purposes of identification and billing, the Member agrees to provide us with current, accurate, complete and updated information including name, address, telephone number and applicable payment data, and further agrees to notify us promptly should any occur. If through no fault of ours, the payment account does not contain sufficient funds to complete the transaction, or the payment account or credit card does not otherwise permit the transaction to be executed, the Member will be charged an insufficient funds fee of $35. We will contact the Member to update their account with a working payment method. We reserve the right to change pricing at any time upon 30 days notice. Should prices increase, the Member has the right to cancel Membership without penalty during initial period following cancellation guidelines as described below. The Member has the right to receive a notice of change in the event that we make any change to the terms and conditions of the Membership that will vary the amount to be periodically billed to the account specified above. We will send a notice of change via the email address on the application at least 30 days prior to the effective date of such change. Except as expressly provided herein, we may modify our services or the terms and conditions of this agreement at any time without notice and such modifications shall be deemed effective immediately upon making such changes. We reserve the right to revoke Membership at any time for misconduct or lewd behavior on our premises. The Member will be responsible for payment in full upon revocation of Membership.
REFERRALS: If a friend or family Member is referred to Massage Associates and signed up for a Membership and both of Members remain in good standing for the new Members initial three-month period, the referring Member will receive a discount on their Membership dues for the following month (amount indicated on the front page).
CANCELLING AN APPOINTMENT: The Member may cancel their appointment without charge if canceled 24 hours or more prior to the appointment. Cancelling 24 hours or less prior to the appointment or not showing up for the appointment will result in forfeiture of that scheduled appointment. If late, the appointment time will be shortened by the amount of time the Member is late.
CANCELLATION OF MEMBERSHIP DURING AUTO RENEW TERM: A Member may cancel their Membership after the initial three-month term. All cancellations require 30 days written notice and are effective immediately after the 30-day notice period. Payments due prior to the effective date will be charged as scheduled. Prepaid Memberships have no cash value according to agreed terms. We reserve the right to terminate or deny re-enrollment for an indeterminate amount of time if the Member has an unsatisfactory payment history. If the Membership account becomes delinquent and is not properly cancelled, the account will be referred to collections and the Member agrees to pay all reasonable collections, agency fees, and legal costs incurred.
CANCELLATION OF MEMBERSHIP DURING INITIAL TERM: The Member may cancel this agreement during the initial three-month term of their Membership upon the following conditions: The Member has a physician’s note certifying that they are no longer able to receive the specified service or if they move 30+ miles away. If living 30 miles or more away at time of signing this agreement, this condition is void, unless the Member moves to a new, further location. Proof of new address will be required. Cancellation of Membership outside of the accordance of this agreement will result in a charge for two months of the contracted Membership.
FREEZING OF MEMBERSHIP: If a Member needs to put their Membership on hold due to being out of town or having medical reasons, the Member may put the Membership on hold for up to three months in a rolling 12-month period. Holds can be for one month at a time, or for up to three months in a row. To place the Membership on hold we require a written notice two (2) weeks in advance for the hold to take effect.
DISCLAIMER OF LIABILITY: The Member understands and voluntarily accepts any risks associated with massage treatment or the use of our facilities. Except where prohibited by law, the Member agrees that Massage Associates LLC and its staff will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, economic loss, or any damage to the Member resulting from negligence, or other acts from anyone on Massage Associates LLCs' behalf or anyone using the services and/or facilities of Massage Associates LLC.
By signing above, the Member authorizes Massage Associates LLC to charge the credit/debit card he/she has specified on the application. Monthly dues and/or renewal fees (plus all applicable taxes) will be withdrawn on the 1st and no later than the 10th of each month. The Member understands that Massage Associates LLC may continue to charge the account or cancel the Membership in accordance with the terms and conditions of this agreement. The Member authorizes Massage Associates LLC to charge the credit card on file in lieu of presenting it for any services received, at the Member’s request. The Member’s signature above indicates that he/she has read and agree to pay for the Membership, according to this agreement and to be bound by its terms, conditions, rules, and regulations.
